Nygren attorney asks judge to put lawmaker on recall ballot

The attorney for state Rep. John Nygren argued this morning that the will of the electorate should compel a Dane County judge to place the Marinette Republican on the recall ballot in the 30th SD.

“There’s no interest that the state of Wisconsin has to keep people off the ballot,” attorney Eric McLeod said.

McLeod urged Judge Richard Niess to find two signatures the Government Accountability Board rejected should be reinstated. One man listed his work address outside of the district on the nomination papers, though his home address is in the district. The GAB also rejected a woman’s signature because she also signed the nomination papers for GOP recall candidate David VanderLeest first. Nygren’s campaign has produced an affidavit from her stating she plans to vote for Nygren.

McLeod also argued that while Nygren failed to sign his own nomination papers as an elector, his signature as a circulator should also count toward the threshold to get on the ballot.

The GAB ruled unanimously that Nygren had 398 valid signatures, two short of the 400 he needed to get on the ballot.

Niess questioned McLeod why he should overrule the retired judges on the GAB, who unanimously ruled that Nygren had failed to meet the threshold to get on the ballot.

McLeod answered that they’re not acting as judges, but part of an administrative agency.

Attorneys for the GAB argued the signatures should not be counted and even if they are valid, he still should not be given ballot access because he initially failed to meet the state requirements for qualifying as a candidate by providing a sufficient number of signatures in the appropriate form.

“Mr. Nygren is not entitled to a do over,” said GAB attorney Lewis Beilin.
